What is a treaty? A treaty is an agreement between two or more countries. So a agreement between two or more countries is a treaty. What does "We the People's" constitution state in regards to a treaty? Article II Section 2, second paragraph states; "He (the President) shall have power, by and with the advice and consent of the senate, to make treaties, provided two thirds of the senators present concur (agree);". What does the constitution state about a agreement? It is never mentioned within the constitution because the founding fathers understood that a treaty and a agreement are one in the same, being two different words for the same action offering the same result. The needed two thirds concurring vote of the senate is to ensure that the treaty or agreement is in the best interest of our nation and then our allies interests. Also, Israel, the one nation with the most to lose was never part of the process.
Barack "we are giving them the O-Bomb-A Bomb" Obama stated he had the power to make a agreement with Iran without the senate's oversight. The republican controlled progressive congress bit on this theory and sponsored the Iran Nuclear Agreement Review Act of 2015 — sponsored by Senate Foreign Relations Chairman Bob Corker, a Tennessee republican — ensured congressional review and oversight of the agreement. The senate wrote the bill, the House of Representatives concurred with a passing vote and the President happily signed it into law. But the new law now states that the senate can only override the presidential agreement with a non-concurring two thirds vote of "nay" which is the exact opposite of what our constitution states. This basically removes the senate from the process of making treaties.
How do you think the supreme court will rule on this action if the action is questioned? Will it use the present result as a precedent in a ruling for the same action in the future? Will Israel have to act alone in its own interest of existence to now be condemned by the governments of the world including ours? Has "We the People's Constitution" been circumvented with a un-constitutional "common law?" Are the republicans in congress that progressively stupid? The answers are the liberal supreme court will rule with O-Bomb-A, depends on how it affects the liberal agenda, with all the other answers being "Yes".
Stupidity is not the greatest problem "We the People" now face. The shredding of "We the People's" constitution being the only document that stands between "the People" and a dictator being a un-constitutional president or a dictating un-Constitutional government.
